A Hartlepool Councillor could well be facing the sack from his day job as a tanker driver after being convicted of his second drink driving offence. And without wishing to sound facetious, it is impossible to be a tanker driver when you are banned from driving.

The Councillor, Shane Moore was found by police in his car at around 1 am, asleep behind the wheel.

The police administered a roadside breath test, which Moore failed and he was then taken to Hartlepool Police Station. When interviewed by the police Moore stated he couldn’t remember driving that night and was surprised at the reading as he had a limited amount to drink.

Declining to give evidence at trial, Moore was convicted of a drink driving offence.

The court had heard from PC Tony Kolodziej, who stated how he and his colleague had stopped to see if Moore needed any assistance. When the driver’s door was opened, PC Kolodziej told the court; “It was apparent the driver was asleep, I could hear snores, and see his chest moving up and down.

“There was a strong smell of alcohol, and when the driver spoke his speech was slurred.”

At the police station, Moore gave to further breath tests, the lowest of which was 105mcg of alcohol in 100ml of breath. The current legal limit in England and Wales is 35mcg.

Following his conviction for this offence, the court also heard that Moore had a like conviction dating back to 2005.

Moore was disqualified from driving for 2 years, ordered to undertake 60 hours of unpaid work and pay costs of £705.

Figures released by Leicester, Leicestershire and Rutland Road Safety Partnership show that 44 people have been arrested fro drink driving with a further 2 being arrested for drug driving.

Leicestershire Police have noted how they are only 2 thirds of the way through their drink and drug driving campaign and have arrested 17 more than at the same point last year.

The campaign was launched at the start of June with drivers being urged to know their limits when getting behind the wheel.

So far, 14 of those arrested have been under the age of 24 years.

The Partnership continued how 17 of those arrests were after a collision and 10 were with drivers who were still over the drink driving limit, the morning after they had been drinking.

Chief Inspector Andy Hall, who is overseeing the campaign across the East Midlands, said: “Too many people are still risking both their lives and those of innocent people, by getting behind the wheel while unfit to drive.

“It is just not worth the risk if you choose to drink and drug drive our round the clock patrols will catch you whether you are in the city, our towns or our villages.”

Leicestershire Police are to be staging extra patrols throughout June but they emphasised how “cracking down” on drink and drug drivers is a year-round commitment.

A drug driver who caused the death of a motorcyclist has been jailed for 5 years and 4 months.

The 45-year-old driver, Paul Mayor admitted the offence at Told Crown Court as the judge heard how the 33-year-old motorcyclist, Lee Bennison was the father to an 18-month-old baby.

The court heard how Mayor turned straight into the path of Bennison, despite him being visible for around 22 seconds.

It was also reported that just 3 days before the tragedy, Mayor was bailed for an earlier incident of driving whilst under the influence of drugs.

Bennison, who sadly sided at the scene of the collision was described as a “brilliant daddy.”

When tested, Mayor was found to have more than 6 times the legal amount of benzoylecgonine in his system.

Other than being jailed for 5 years and 4 months, Mayor was also banned from driving for 7 years and ordered to take an extended re-test.

Dan Wallace, the Commonwealth Games Gold medallist has been suspended by British Swimming and Scottish Swimming, after he pleaded guilty to a drink-driving charge.

The 24-year-old famously shouted “For freedom” as he won the 400m individual medley at Glasgow in 2014. He also wore a kilt on the podium as he received his gold medal.

He has now been suspended from all national swimming programs for 3 months. Scottish Swimming stated how Wallace had been suspended owing to “a violation of the athlete code of conduct”.

Following his guilty plea, Wallace issued a statement, in which he stated: “It is with much regret that I was found to be driving under the influence of alcohol.

“Not only have I let myself, my family and team-mates down I have put others at risk and I am profoundly sorry for my actions.

“I recognise that I am in a position of influence and this type of behaviour is not acceptable in any way, shape or form.

“I am now looking to rebuild trust in everyone who has supported me and put their faith in me and will do whatever it takes to come through this a better, stronger person.

“I am deeply sorry.”

A man has appeared at Carlisle Magistrates Court after being caught driving whilst being 16 times over the drug driving limit.

28-year-old Craig Sinkinson was stopped by police whilst he was driving his Ford Fiesta. On speaking to him, the officers suspected he was under the influence of drugs and subjected him to a roadside drug test. The test proved positive for cocaine and cannabis.

The court heard how Sinkinson fully cooperated with the police and admitted that he had smoked cannabis merely 20 minutes before he was pulled over.

An analysis of his blood showed he had 800mcg of Benzoylecgonine in his system, with the legal limit being 50mcg.

He also had 4.6mcg of THC, with the legal limit being 2mcg.

Telling Magistrates that he felt okay at the time he was driving, Sinkinson was banned from driving for 23 months.

It has been reported how more pensioners are being caught drink driving because they still think they are safe to get behind the wheel after a few drinks.

The Daily Telegraph has revealed figures from the Ministry of Justice, following a Freedom of Information request, showing how the numbers of under 19-year-olds being caught drink driving has lowered whilst elderly drivers being caught behind the wheel after a few drink is on the rise.

The data showed how 2010, 6,744 under 19s were caught drink driving, whereas, in 2015, that figure dropped to 1,436.

Conversely, in 2010, 1,295 elderly drivers were caught drink-driving, and by 2015 that figure had increased to 1,435.

The figures also showed how the overall number of drink driving convictions had dropped from 84,540 in 2010 to 45,970 in 2015.

Comments from the AA have indicated that it may be the increasing price of alcohol which has been a factor in young people not drinking and driving. In short, they just can’t afford to.

A spokesman from the AA stated: “For the younger drivers, the cost of alcohol in pubs and nightspots will have put downward pressure on drink-drive statistics in their age group.

“However, there is a need for targeted policing of places with late night drinking.

“Although the majority will heed the warnings, it is the minority who flout the law and still pose a high risk.

“They are called the hardcore – a cross-over group that includes elderly drink drivers and others from all age groups.

“Hardcore older drink drivers will have developed bad habits over years, probably got away with it in the past and believe they can still drive safely when half-cut.”

He added: “What is surprising is that, with more of the enforcement done the morning after to catch the home boozers, the number of elderly drivers caught has gone up.

“With less likelihood of retirees needing to get up early to go to work, the chances of getting caught at that time of day must be lower.”

A man who was caught driving at almost 150MPh was found to be over the drink driving limit when he was stopped by police.

The driver, Billie Rich, was driving his BMW in the early hours of the morning when he overtook an unmarked police car at speed on the A350.

The police car then followed him onto the M4 where the high speeds were recorded and he was pulled over.

Appearing at Swindon Magistrates’ Court, Rich pleaded guilty to drink driving and speeding and was banned from driving for 22 months and fined £692.

An officer in the case, PC Andy Lee, later stated: “His actions put himself, other drivers and road users in danger.”

The country’s best-known traffic lawyer is backing a motorist’s fight against a bus lane fine imposed by Hull City Council.

Thirty-six-year-old Tony Sherwin contacted Nick Freeman, aka Mr Loophole, via social media after being fined £30 for driving in the bus lane on Holderness Road to visit a supermarket.

Mr Sherwin appealed the fine, which he lost, and has subsequently lodged a complaint with the Traffic Penalty Tribunal.

Earlier this year Tesco changed the entrance and exit to its Tesco Express store, meaning that motorists are now forced to enter into the bus lane in order to access the shop.

Mr Sherwin is one of a number of supermarket customers to have subsequently been fined because they drove a short distance in the bus lane, which is in the nearside lane, before turning left into the Tesco entrance.

Mr Freeman, whose clients include David Beckham, Jeremy Clarkson and Jimmy Carr, said: “Mr Sherwin contacted me seeking my legal opinion in relation to this matter.

“I think his fine should be set aside and the bus lane should commence after the entrance to avoid infringing Section 103 of the Highway Code.

“Motorists are advised to give clear signals in plenty of time which are not misleading and do not lead to confusion. The current geographical layout prevents all three aspects of this section of the code being complied with.

“Moreover, with this existing layout, motorists have to cut from the outside lane across the bus lane to access the Tesco entrance. This is not only dangerous but also forces the motorist into the bus lane during prohibited times.

“In my view good old fashion sense should prevail and the commencement of the bus lane should be moved a few yards further up Holderness Road.

“The current system entraps the motorist to commit an offence and Mr Sherwin is correct in stating that motorists in this particular circumstance are being used as cash cows.”

Mr Freeman added: “I therefore recommend that council highways chiefs drive this stretch of road as a matter of urgency and do the honourable thing in relation to this situation, in other words they cancel the fine and move the bus lane.”

A mother has been arrested for crashing into five cars after drinking wine at her husband’s birthday party.

After drinking, Gemma Hewes, a property executive, got behind the wheel of her Land Rover along with children who were in the back.

The bench at Wimbledon Magistrates Court heard how Hewes was distracted by a phone call before colliding with a line of parked cars, resulting in a Renault Espace being written off, and the steering column of her own vehicle snapping.

Hewes pleaded guilty to drink driving and careless driving and admitted she had asked the owners of the vehicles involved not to call the police as she had been drinking.

She was disqualified from driving for 17 months and fined £1350.

A police detective has been dismissed after he has admitted driving at 90mp and giving a drink-driving reading of over 3 times the legal limit.

Mark O’Brien admitted his offences at Gateshead Magistrates Court and has been banned from driving for 25 months.

After drinking wine at lunch, the court was told how O’Brien was seen swerving from side to side by police officers and ignoring their blue flashing lights. It was only when the police car pulled alongside and officers made eye contact with him that he stopped.

The court also heard that when he got out of his vehicle, O’Brien stumbled and almost fell into the road and that when breathalysed, it showed him to be over 3 times the legal limit.

O’Brien faced a Police Disciplinary Tribunal on 23 May and was subsequently dismissed from the force. Chairwoman Rachel Mangenie told him how he had damaged confidence in the police as she delivered her decision.

“The panel concludes that the appropriate action is dismissal without notice.”

“He has been a very fine police officer and served the public well. Sadly, it’s his actions and the decisions he made that have brought him to this hearing and, ultimately, this outcome.

“He was driving on a busy carriageway. It is only by luck that there was no accident and DC O’Brien did not cause injury to himself or another motorist or passenger.

“This type of offending undermines public confidence. An outcome where he was allowed to remain an officer would seriously undermine the confidence the public has in Northumbria Police.”

O’Brien had worked his way up to the Safe Guarding Unit, working with victims of serious domestic violence and rape.
