Driving with no insurance
This is a strict liability offence which is punishable by the imposition of 6 penalty points onto the driving licence of the driver and/or the person permitting use of the vehicle without insurance. However, the Police and insurance database is often inaccurate and drivers are often covered to drive vehicles under policies that they were unaware of at the time. This can result in the successful conclusion of such cases without the necessity of a trial.
Similarly, it is often the case that special reasons apply which can result in the avoidance of the standard sentence of 6 penalty points. This is however subject to the Court’s approval and the exercise of their discretion to avoid endorsing points. See special reasons.
