Failure to provide specimen

It is an offence for a person who has been required to provide specimens for analysis to fail without reasonable excuse to do so. Requests for a specimen are normally required when an individual is pulled over on suspicion of driving with excess alcohol or driving whilst unfit. This is a particularly complex area of law and the authorities may seek to obtain an evidential breath specimen, urine or blood sample.
