A man who was jailed for drink driving and appealed against his two-year jail sentence for being ‘too harsh’ has had his sentence upheld by judges.
Stephen Mackie from Andover was sentenced at Winchester Crown Court on April 28 and the Appeal Court in London heard of his dangerous driving and sentence on 25 July.
It was reported how Mackie drove at speed, over-took and under-took other vehicles, drove on the wrong side of the road and struggled to control his vehicle on bends.
His car finally came to a halt after sustaining damage to one of the tyres following a collision with a kerb.
Mackie pleaded guilty to dangerous driving, drink-driving, failing to produce a specimen for analysis, as well as driving while disqualified and without insurance.
In addition to this, he was in breach of a suspended sentence from 2016 for possession of a knife in a public place. This six-month sentence was activated and incorporated into his two-year jail term.
Judge Johanna Cutts QC described his driving as ‘grotesque’ and that it was a ‘miracle’ that no-one was hurt. His lawyers argued it was ‘not the very worst case of dangerous driving’ and that the term was far too harsh.
Judge Cutts was not moved, however, and said it was a ‘prolonged period of significant dangerous driving by Mackie, who was nearly twice the legal limit for alcohol’.
Sitting with Lord Justice Treacy and Ms Justice Russell, Judge Cutts also said that Mackie was ‘fortunate’ that no-one had been hurt. They concluded, “This sentence cannot be said to be manifestly excessive and this appeal is dismissed”.
