Magistrates in Chesterfield have banned a 32-year-old man from the roads for 12 months after he was caught drink driving following an ANPR check on his vehicle.
Sarah Haslam, prosecuting, told the court: “He was driving on Sheffield Road just before midnight and the vehicle was flagged as having no insurance after an ANPR check and the police pulled him over.
“He smelled of alcohol and he failed a roadside breath test.”
Tests at the police station showed the defendant to have 56mcg alcohol per 100ml breath. The legal drink driving limit is 35mcg.
Defending the driver, Kirsty Sargent said that her client had drunk a couple of cans the previous evening, and a little more in the early hours of the morning, but didn’t believe he would be over the drink driving limit.
He had been delivering tools to a friend as a favour.
Regarding his insurance, said Ms Sargent, the man thought he had been paying via Direct Debit and was unaware that it had failed.
She went on to explain that her client suffered from Crohn’s Disease, the medication for which alters his metabolism which he believes may have influenced his alcohol reading.
Magistrates fined the man £120 and ordered him to pay £85 costs and a victim surcharge of £30 in addition to the ban.
His ban may be reduced by 13 weeks if he completes the drink driving rehabilitation course.
