A 31-year-old man from Bridgend, Wales, has been jailed for five years and four months after he collided head-on with another car while drink driving, killing the other driver’s three-year-old son.
Plymouth Crown Court heard how the motorist was seen tailgating and overtaking on a winding country road in Devon before finally losing control on a bend, hitting an oncoming car.
The driver of the other vehicle suffered a badly broken arm while her son was killed instantly.
The prosecution told the court that the man had admitted to drinking the night before the accident and had “topped up” with a lager before his journey on 20th December 2017.
After losing control of his Honda Civic, the motorist hit a bank on the opposite side of the road, becoming airborne and landing on the front of the oncoming vehicle, causing fatal head wounds to the toddler.
Following the smash, the driver was found to have 98mcg alcohol per 100ml breath where the legal limit is 35mcg. The car was also found to have two defective tyres.
In a statement read to the court, the boy’s mother said: “I will never see [him] grow up, start school, make friends, develop his own personality and interests.
“I feel like I have been punched in the stomach and been winded.
“Six months later and I still struggle.
“My life feels empty now.
“It feels like every minute of my life has been altered by [his] death. There are no toys under my feet, there is no toddler chatter, there is no wild child to play with, to feed, to comfort, to bathe, to put to bed.
“I was responsible for looking after [him] on that day and as his mother always. I find it hard not to feel like I have failed in my job as I did not manage to keep him safe.”
After pleading guilty to drink driving and causing death by dangerous driving, Judge Peter Johnson jailed the man for five years, four months.
“You tailgated and overtook vehicles when it was unsafe to do so,” he said.
“One witness described your driving as outrageous,” before adding that the loss of the boy had left an “infallible void”.
