A motorist spotted drink driving by another road user has been given a suspended jail sentence after it was found she was more than three times the legal limit.
The Hong Kong resident was visiting family in Chesterfield when she drove to the railway station to collect her husband.
Lynn Bickley, prosecuting, said: “A witness followed [the defendant] driving her vehicle from Chesterfield Road, Brimington, to Chesterfield railway station and he observed her vehicle swerving along the road and it hitting a kerb.”
Following her arrest, the 40-year-old gave a reading of 123mcg alcohol per 100ml breath. The legal limit is 35mcg.
Mitigating for the woman, Kevin Tomlinson told the court: “The incident occurred as a consequence of [my client] having consumed an amount of alcohol before setting off from the family home in the Inkersall area to collect her husband from Chesterfield railway station and she drove her vehicle with no one in it with her only intention to collect her husband.”
He added that the woman is recovering from alcohol addiction and had suffered a relapse, but is due to receive treatment as an inpatient.
“[My client] has been distressed at the prospect of coming to court and she wishes to apologise to the court for her actions and she realises they were wrong and she realises the seriousness of it and assures you it will not happen again.”
After pleading guilty to drink driving, Magistrates sentenced her to eight weeks in prison, suspended for 12 months. She was also banned from the roads for 30 months, ordered to pay £85 costs and a £115 victim surcharge.
