A 52-year-old businessman has been jailed after two witnesses, eleven miles apart, saw him drink driving over the May Bank Holiday weekend.
Prosecuting, Julian Tanikal told the court that the first witness saw the defendant near Whitewell-on-the-Hill at 6.20pm, while the second saw him near Rillington at 7.13pm. The witness then followed the man, guiding officers by phone to catch up with him.
When police finally caught up with the drink driving motorist, they had to help him out of the car due to his inebriated state. On conducting a breathalyser test, results showed him to have 174mcg alcohol per 100ml breath. The legal limit is 35mcg.
District Judge Adrian Lower described his reading as “exceptionally high”.
Defending the man, Pippa Carruthers told York Magistrates that her client had never before been in trouble with the police and that doctors told him he may only have a year to live due to cirrhosis of the liver – caused by long-term alcoholism.
The man, who runs corporate courses and workshops, was weaving within his lane when officers caught up to him said Mr Tanikal, while Mrs Carruthers stated that her client had stayed off alcohol for some years following his cirrhosis diagnosis.
The reason for his relapse, she said, was that he had been invited to a 50th birthday reunion where he had started drinking, and then continued the next day.
His arrangement for transport from the reunion fell through, so he decided to drive.
The judge went on to say: “The A64 is a busy road, a dangerous road where accidents happen all too often.
“Drinking and driving kills people. It kills people every day of the week.
“The law-abiding public expects, quite rightly, the courts to send a strong message to people who drink and drive, particularly at the level you drunk and drove, that this sort of behaviour will not be tolerated.”
The Leeds man pleaded guilty to drink driving, and District Judge Lower jailed him for 16 weeks, also banning him from the roads for five years.
