Chesterfield Magistrates have heard how police caught a man drink-driving because they spotted him driving without headlights.
Prosecuting, Becky Allsop said: “It was just after midnight when police were on patrol and saw the vehicle driving towards them at speed without lights on and they stopped him.
“He admitted he had had a drink that evening.”
Carr pleaded guilty to drink driving following his arrest on December 7, where tests showed him to have 79mcg alcohol per 100ml breath, just over twice the legal drink-drive limit of 35mcg.
Defending his client, John Cavanagh explained that Carr had been driving home following a visit to his estranged partner, who he believed had formed a new relationship with another man. She denied the relationship, however on arrival at her house Carr ended up in an argument with a man who was present on the premises at the time.
In mitigation, Cavanagh said that while Carr had been drink-driving, there was no evidence of bad or dangerous driving.
Carr was banned from the roads for 20 months, fined £265, ordered to pay £85 costs and a £30 victim surcharge. Five months may be taken off the ban should he complete a drink-drive rehabilitation course.
