A driver who was caught using his mobile phone while driving has been allowed to continue to drive as he is a member of the RNLI lifeboat crew and needs to respond to emergency call-outs.

Relief Magistrate Sarah Fitz said the court was prepared to make an exception to usual policy due to Stephen White’s work with the St Catherine’s lifeboat.

As a substitute, 33-year-old White was fined £350 and had his license endorsed after admitting to holding a mobile phone whilst driving.

White was spotted using his phone while driving a light commercial vehicle on 11 July, said Centenier Amanda Wright. He was spotted looking down as he drove towards a pedestrian crossing. He also had a previous conviction for a mobile phone offence from 2015.

Defending his client, Advocate Julian Gollop said White was a “public spirited individual” who required his licence to be able to respond to emergency call-outs, as well as for his work.

“His job is fencing and shed building and he needs to go from his home in St Helier to his work in St Martin. He also needs to drive while working,” said Gollop.

He went on to say that White had taken steps to ensure there was no repetition. His car now had a Bluetooth system for hands-free use, and for work White put his phone on silent and didn’t touch it until he stopped.
