The country’s leading traffic lawyer has said new legislation aimed at deterring drivers from illegally using mobile phones does not go far enough.

From tomorrow (Wednesday March 1), drivers flouting the law will be fined £200 and will now have their licence endorsed with six penalty points instead of three – and without the option of swapping the points for an “awareness course”.

But Nick Freeman, aka Mr Loophole, said without a true deterrent such as a 12-month ban – coupled with an effective visible police presence – the new legislation would not achieve its desired impact.

Mr Freeman said: “Motorists know that the majority of policing is done robotically by camera, which can only detect those speeding.

“They are also aware of the dwindling number of dedicated traffic officers, so the chance of them being caught is minimal. It is for this reason that so many drivers are still tempted to flout the law.

“Research has demonstrated that mobile phone usage is as great a distraction as drink driving, and yet the Government is reluctant to provide a parity sentence.

“Whilst increasing the financial penalty and doubling the number of penalty points is a step in the right direction, I do not believe the new sentencing powers go far enough.

“In my view, only an immediate 12-month disqualification would seriously impact on a driver’s decision making process, and would be sufficient to act as an effective deterrent.

“Moreover, the habit of mobile phone usage in a car needs to be stigmatised in the same way that drink driving was decades ago. This can be done by education and an effective advertising campaign.”
