Magistrates in Lancashire have disqualified a man from driving after he was caught drink driving at twice the legal limit in Rossendale – the latest in a string of offences dating back to 2001.
The 41-year-old from Nelson was found pulled over on a grass verge on February 5, 2018. When officers breathalysed him he was found to have 80mcg alcohol per 100ml breath – more than twice the legal limit of 35mcg.
Prosecuting, Roger Brown said: “An ambulance was driving along the road and came across the Vauxhall Astra. The car was parked half on the verge [and] the defendant was in the driving seat. The officers who spoke to the defendant described him as crying and there was a smell of alcohol. Neither of the officers made reference to there being drink in the car.”
David Lawson, mitigating, said that his client was “effectively living in his car” after a fall-out with his father. His mother had also recently died, and the two situations had caused him a considerable amount of grief.
“My client has had a traumatic part of his life,” said Mr Lawson. “He has had problems with alcohol. Clearly he has previous records. On this occasion, he was not in a good state of mind.”
After pleading guilty to the drink driving charges the defendant was handed a custodial sentence of 20 weeks, suspended for 18 months and ordered to pay a fine of £620 and a victim surcharge of £115 in addition to the three-year driving ban.
