Kirklees Magistrates have heard how a man was caught drug driving because police officers saw him driving with his mobile phone.
Once he had been pulled over for driving with his mobile, police officers could smell cannabis coming from the defendant’s Audi A3.
Prosecuting, Andy Wills said that the man was stopped just after 9pm on Tuesday, February 20 in Dewsbury.
“He initially caught the attention of police because he was using his mobile at the time.
“The defendant was invited into the back of the police vehicle and while speaking to him they could smell cannabis coming from him.”
A roadside drug swipe showed that cannabis, a class B drug, was present in his system, and he was subsequently arrested and taken into custody at Huddersfield Police Station.
Blood tests revealed the motorist to have more than 7mcg Delta-9-Tetrahydrocannabinol (D9-THC – the active ingredient in cannabis) per 100ml blood. This is three-and-a-half times the legal limit of 2mcg.
The 32-year-old man had previously appeared in court in 2016 on possession charges and was handed a community order.
Mitigating, Daniel Metcalfe told the court that his client was driving to see his daughter, who was unwell.
“He had smoked cannabis in the morning and made the decision to drive the vehicle not feeling that he was impaired.
“The reason police were drawn to him was because he was fiddling with his mobile phone and not due to a poor standard of driving.”
After pleading guilty to driving under the influence of drugs while over the prescribed limit, the defendant was banned from driving for 12 months, ordered to pay a £120 fine plus £85 costs and a £30 victim surcharge.
